General Terms and Conditions

1. Scope of application

These General Terms and Conditions (GTC) apply to all orders placed by consumers (§ 13 BGB) via the online store of NaturaThai UG (haftungsbeschränkt), Schloßallee 44, 13156 Berlin.

3. Offer and conclusion of contract

(1) The presentation of the products in the online store does not constitute a legally binding offer, but an invitation to place an order.

(2) By clicking on the "Buy" button, you place a binding order for the goods contained in the shopping cart.

(3) We will confirm receipt of your order immediately by e-mail. This order confirmation does not constitute acceptance of the contract.

(4) The contract is only concluded when we accept your order by sending an order confirmation by e-mail or deliver the goods.

4. Product safety and intended use

(1) The cosmetic products offered by us comply with the applicable regulations of the European Union, in particular the EU Cosmetics Regulation (Regulation (EC) No. 1223/2009).

(2) Our products are intended exclusively for external use and must not be ingested.

(3) Please read the product information and instructions for use carefully before using the products.

5. Prices and payment

(1) The prices quoted include statutory VAT and other price components.

(2) Shipping costs are shown separately and are to be borne by the customer.

(3) Payment is made by prepayment, PayPal, credit card or other payment methods offered in the store.

(4) In the event of late payment, we reserve the right to charge reminder fees.

6. Delivery

(1) Delivery shall be made to the delivery address specified by the customer within Germany and throughout Europe.

(2) Unless otherwise stated, the delivery time is approx. 3-7 working days within Germany and approx. 7-14 working days throughout Europe.

(3) If a product is not available, we will inform you immediately and reserve the right to withdraw from the contract.

7. Right of withdrawal

Consumers have the statutory right of withdrawal in accordance with the withdrawal policy, which is explained separately in the online store and in the order confirmation.

8. Limitation of liability and product liability

(1) The customer undertakes to use the products only in accordance with the respective product description and instructions.

(2) NaturaThai UG (haftungsbeschränkt) is not liable for damage to health caused by improper use or allergic reactions due to the ingredients.

(3) The products are purchased by us unchanged from the manufacturer, for whose quality and ingredients the manufacturer is responsible.

(4) The liability of NaturaThai UG (haftungsbeschränkt) is limited to intent and gross negligence to the extent permitted by law.

(5) Claims arising from product liability remain unaffected.

9. Warranty

(1) The statutory warranty rights shall apply.

(2) We accept no liability for damage caused by improper use or incorrect storage.

10. Retention of title

The goods remain our property until full payment has been made.

11. Data protection

Information on data protection can be found in our privacy policy on the website.

12. Applicable law and place of jurisdiction

(1) The law of the Federal Republic of Germany shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods.

(2) The place of jurisdiction is, as far as permissible, Berlin.
